Why make a Will?
- If you don’t leave a Will, then quite simply, you lose control of what will happen to your assets following your death.
- Whilst broadly speaking your estate will pass to your next of kin, it is not always as straight forward as it may seem for instance, if you leave a spouse, your whole estate may not actually pass to him or her.
- Your next of kin legally may be a family member to whom you wouldn’t wish to leave your estate under normal circumstances.
- A lifetime companion to whom you are not married and who is not a family member will not benefit at all.
- If you have no next of kin, then your estate will pass to the Crown.
- Your estate may be liable for a significant sum of Inheritance Tax, which may not be payable if you have a Will.
- You will not have an Executor to administer your estate. Instead personal representatives will be chosen according to the law and not because you want them to deal with your affairs. The personal representative will only have limited powers to deal with your estate and may not be able to carry out your wishes as you would have liked.
- In leaving a Will you can also make other important decisions, such as appointing Guardians for your children or giving express wishes about the disposal of your body.
